Terms of exchange or return
A Customer who is also a consumer within the meaning of Art. 22[1] of the Civil Code of 23 April 1964 (Journal of Laws No. 16, item 93, as amended), who has concluded a distance contract, in accordance with Art. 38 of the Act of 30 May 2014 on Consumer Rights (i.e. Journal of Laws of 2023, item 2759, as amended), for a personalized product / non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individual needs, does not have the right to withdraw from the contract. The right to withdraw from a contract concluded off-premises or at a distance does not apply to the consumer in respect of contracts:
- For the provision of services for which the consumer is obliged to pay the price, if the entrepreneur has fully performed the service with the express and prior consent of the consumer, who was informed before the commencement of the service that after the entrepreneur has performed the service, he will lose the right to withdraw from the contract, and has acknowledged this;
- Where the price or remuneration depends on fluctuations in the financial market over which the entrepreneur has no control and which may occur before the deadline for withdrawal from the contract expires.
- Where the subject of the service is a non-prefabricated good, manufactured according to the consumer’s specifications or intended to meet his individual needs.
- where the subject of the service is a good that spoils quickly or has a short shelf life.
- In which the subject of the provision are goods which, after delivery, due to their nature, are inseparably connected with other goods (ramp, skatepark).
Complaints about goods
- SZPLINRAMPS.PL, as a seller, is liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular Article 556 and Articles 556[1]-556[3] of the Civil Code.
- Complaints arising from a violation of the Customer's rights guaranteed by law or under these Terms and Conditions should be directed to: Szplinramps, Lubień 3, 64-361 Miedzichowo; kontakt@szplinramps.pl. It is recommended that complaints be submitted in writing or by email to kontakt@szplinramps.pl. To expedite and facilitate the complaint handling process, it is recommended that any additional information, such as the order number, date of sale, etc., be sent along with the complaint.
- SZPLINRAMPS.PL undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Customer within this period when the complaint will be considered.
- The response to the complaint will be sent to the address provided by the Customer or in another manner indicated by the Customer.
- SZPLINRAMPS.PL is the manufacturer of the Goods. The Manufacturer may be liable under the warranty for the Goods sold under the terms and for the period specified in the warranty card. If the warranty document provides such a possibility, the Customer may submit their warranty claims directly to an authorized service center, the address of which is provided in the warranty card.
